This document represents Welcome to West Georgia’s intended terms. Final language is being reviewed by counsel and the Real Broker LLC compliance team. Effective date TBD. Last updated May 7, 2026.

This Production Agreement ("Agreement") governs a one-time cinematic commercial purchased through Welcome to West Georgia, with no monthly subscription required.

1. Parties

This Agreement is between [ENTITY_NAME — pending] d/b/a Welcome to West Georgia ("WTG") and the business that completes Stripe Checkout for the one-off commercial offer ("Business").

2. Scope of Work

Default scope: a single cinematic commercial reel, shot on location with WTG’s production setup, plus social-format cuts (vertical 9:16 and square 1:1).

Specific deliverables, shoot dates, and location are confirmed in writing between WTG and Business after Checkout. Anything outside the default scope (additional shoot days, talent fees, drone work outside FAA Part 107 limits, multi-day post production) may be quoted as an add-on.

3. Fees and Refunds

A 50% deposit is collected at Checkout. The remaining 50% is invoiced on delivery of the final edited deliverable.

Pre-shoot cancellation: deposit is refunded in full minus any third-party costs WTG has already incurred (location fees, talent holds, equipment rentals).

Once the shoot starts: the deposit becomes non-refundable.

Post-delivery refunds: WTG does not issue post-delivery refunds for completed work. If the final deliverable does not match the scope confirmed in writing, WTG will revise it within the included revision rounds.

4. Delivery Timeline

Default: WTG aims to deliver the final edited reel within 21 days of the final shoot day. Specific timelines depend on scope and post-production complexity.

5. Revisions

Two (2) rounds of revisions are included after first delivery. Additional rounds are billed at WTG’s then-current hourly rate. Revisions cover edit-level changes (cuts, music, color, captions). Reshoots are out of scope.

6. Intellectual Property and License

On full payment, WTG grants Business a perpetual, worldwide, non-exclusive, royalty-free license to use the final edited deliverable and the WTG-delivered cuts in Business’s own marketing.

WTG retains ownership of the raw footage and the underlying creative materials. WTG retains the right to use the raw footage and the final reel in WTG’s own portfolio, marketing, and editorial content.

7. Business Representations

Business represents and warrants that: (a) it has full authority to enter into this Agreement; (b) it has lawful access to the locations identified for the shoot; (c) it has obtained all releases and permissions for any persons (including employees) appearing on camera; and (d) any music, talent, or third-party content Business asks WTG to incorporate is properly licensed.

8. Force Majeure

Neither party is liable for delay or failure caused by events outside its reasonable control, including weather, illness, government action, or third-party platform outages. The parties will reschedule in good faith.

9. Disclaimers and Liability

WTG provides the production "as is" and disclaims all warranties to the fullest extent permitted by law.

WTG’s total liability under this Agreement is capped at the fees Business actually paid for this engagement. Neither party will be liable for indirect, incidental, consequential, special, or punitive damages.

10. Governing Law and Disputes

This Agreement is governed by the laws of the State of Georgia. Disputes are resolved as provided in WTG’s Terms of Service at /terms.

11. Acceptance

Business accepts this Agreement by completing Stripe Checkout for the one-off commercial offer. A copy is available at any time at /legal/one-off-commercial-agreement.
