This document represents Welcome to West Georgia’s intended terms. Final language is being reviewed by counsel and the Real Broker LLC compliance team. Effective date TBD. Last updated May 7, 2026.
These Terms govern your use of welcometowestgeorgia.com and any services we offer through it, including subscriptions, one-off commercial production, sponsorship campaigns, and real-estate lead capture.
1. Acceptance
These Terms of Service form an agreement between you and [ENTITY_NAME — pending] (operating as Welcome to West Georgia, "we," "us," or "our"). By accessing or using welcometowestgeorgia.com (the "Site") or paying for any of our services, you accept these Terms.
If you do not agree, do not use the Site or our services.
2. Eligibility
You must be at least 13 years old to use the Site. You must be at least 18 to subscribe to a paid tier (Spark, Featured, or Anchor), purchase a one-off commercial, or claim a business listing on behalf of a business. Sponsorship donations are accepted only from Georgia residents (we enforce a geo gate at checkout).
If you accept these Terms on behalf of an organization, you represent that you have authority to bind that organization.
3. Account, Claim, and Conduct
When you claim a business listing, you represent that you are the owner, an officer, or an authorized agent of that business and that the information you submit is accurate.
You agree to comply with our Acceptable Use Policy at /acceptable-use, which prohibits illegal content, deceptive reviews, defamation, harassment, scraping, security probing without authorization, and similar conduct.
4. User-Submitted Content
You grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, display, distribute, and create derivative works of any content you submit to the Site (including testimonials, claim-form text, contact-form text, and sponsorship messages) for the purpose of operating and promoting the Site.
You represent that you have the rights to grant that license and that the content does not violate any third-party right or law.
5. Our Intellectual Property
The Site, our editorial content (videos, blog posts, city pages, dynamic OG images), brand, logos, and design system are owned by us or licensed to us. You may not copy, reproduce, or redistribute them except as expressly permitted.
For specific tier-related licenses (for example, what a Featured-tier business may do with a cinematic reel we produce), see the relevant Listing Agreement at /legal/spark-listing-agreement, /legal/featured-listing-agreement, /legal/anchor-listing-agreement, or /legal/one-off-commercial-agreement.
6. Payment Terms
Spark ($40/mo), Featured ($299/mo), and Anchor ($1,499/mo) subscriptions auto-renew monthly through Stripe until you cancel. Cancellation stops future renewals; we do not pro-rate partial months.
One-off commercial purchases are one-time payments processed through Stripe. Sponsorship donations are processed through Stripe and refunded automatically if the campaign does not meet its threshold within 90 days.

7. Real Estate
Welcome to West Georgia surfaces real-estate listings and buyer / seller lead capture. Real-estate services are provided by the founder in his capacity as a licensed Georgia real estate agent through Real Broker LLC, not by Welcome to West Georgia itself. Nothing on the Site is legal, tax, or financial advice.
8. Third-Party Links and Services
The Site links to third-party services, including ordering platforms (DoorDash, UberEats, Toast, etc.) reachable through our /api/order/[businessId] redirector. Those services have their own terms; we are not responsible for them.
9. Disclaimers
The Site is provided "as is" and "as available." We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
We do not warrant that the Site will be uninterrupted, error-free, or secure, or that any business information surfaced is current or accurate.
10. Limitation of Liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for lost profits, revenue, data, or goodwill.
Our total liability arising out of or relating to the Site or our services is capped at the greater of (a) the fees you paid us in the 12 months before the claim or (b) one hundred U.S. dollars ($100).
11. Indemnity
You agree to defend, indemnify, and hold us harmless from any claim, damage, or expense (including reasonable attorneys’ fees) arising from your content, your use of the Site, or your violation of these Terms.
12. Termination
You may stop using the Site at any time. We may suspend or terminate your access (including any claimed listing or paid subscription) if you violate these Terms or for any reason on reasonable notice. Sections that by their nature survive termination (IP, disclaimers, liability cap, indemnity, dispute resolution, governing law) will survive.
13. Dispute Resolution and Class-Action Waiver
PLEASE READ CAREFULLY. THIS SECTION AFFECTS YOUR LEGAL RIGHTS.
You and we agree that any dispute arising out of or relating to the Site or our services will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, in Atlanta, Georgia. Either party may instead bring an individual action in small-claims court in Carroll County, Georgia, if it qualifies.
You and we waive any right to participate in a class action, class arbitration, or representative action. The arbitrator may award only individual relief.
Opt-out: you may opt out of arbitration by emailing the contact address below within 30 days of first accepting these Terms; include your name, the email tied to your account, and the words "ARBITRATION OPT-OUT." If you opt out, disputes will be resolved in the state or federal courts located in Carroll County, Georgia, and you and we consent to that jurisdiction.
14. Governing Law
These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles.
15. Changes to These Terms
We may update these Terms from time to time. Material changes will be posted on this page with an updated effective date. If you have an active subscription or claimed listing, we will notify you by email of material changes.
Continued use of the Site after changes take effect means you accept the updated Terms.

17. Severability and Entire Agreement
If any provision of these Terms is held unenforceable, the remaining provisions remain in effect. These Terms, together with our Privacy Policy, Acceptable Use Policy, Cookie Policy, Refund & Billing Policy, Disclosures, and any applicable Listing or Production Agreement, are the entire agreement between you and us regarding the Site.
